The DEA’s response to the GAO report may be good news for cannabis rescheduling, and this episode of TDR Cannabis in 5, presented by FRE, explains why.
Host Shadd Dales covers Marijuana Moment’s report on the agency’s filing in reply to opponents’ push to add a Government Accountability Office report to the hearing record, and argues investors may be reading the headlines backward.
The GAO flagged gaps in how the DEA and FDA document their procedures for scheduling controlled substances. According to the DEA, that’s a finding about written policies, not evidence that the science behind rescheduling was flawed. The agency isn’t objecting to the report being admitted, and the episode makes the case that a government unworried about the document suggests confidence in its position. What it strongly opposes is another round of briefing, testimony or delay, and it says opponents have mischaracterized what the GAO concluded.
The episode also covers what opponents want. Smart Approaches to Marijuana, several states and others are challenging the newer two-part test for accepted medical use against the old five-part approach, and asking for more documents, testimony and discovery. That, the episode argues, is the real risk, not the report itself.
With witnesses heard and final briefs filed, the focus shifts to Chief Administrative Law Judge Derek Julius and whether he reopens the record or moves toward a recommendation.
The takeaway is that admitting the report and reopening the hearing are two very different outcomes, and nothing is guaranteed.
